Article 1 (Application of Site Terms of Use)

Official Site for BAUM Duty Free Shops (the "Website") is a website operated by THE GINZA Co., Ltd ("THE GINZA"). Official Site for BAUM Duty Free Shops Terms of Use (these "Terms") set out basic requirements for the use of the various services (the "Services") offered on the Website. If terms or rules governing a specific service among the Services offered through the Website are established separately, both these Terms and said terms and rules may apply to users' use of the relevant service. These Terms will be applied to all users (hereinafter collectively referred to as the "Users") of the Services.

Article 2 (Definition of Users)

For the purpose of these Terms, any and all persons who use the Services, regardless of whether they are identifiable by THE GINZA, are defined as Users.

Article 3 (Agreement to Terms of Use)

Users who actually use the Services will be deemed to have agreed to these Terms.

Article 4 (Equipment, etc. Necessary to Use the Services)

All costs necessary for using the Services, including terminal equipment, communication devices, software and other facilities and communication charges, will be borne by Users.

Article 5 (Amendment of these Terms)

THE GINZA reserves the right to amend all or part of these Terms at its sole discretion without prior notice to Users. In such cases, THE GINZA will announce the amendment on the Website, and the amendment will take effect when five working days have elapsed since publication of the amendment on the Website. Users who use the Services after the amendment of these Terms has taken effect will be deemed to have agreed to these Terms as amended.

Article 6 (Prohibited Matters)

When using the Website, Users are prohibited by THE GINZA from conducting the following acts (including acts or preparatory acts which may trigger the following acts).

  1. Any act of using the Services for a purpose other than for own personal use
  2. Any act that defames, slanders or otherwise damages, or may defame, slander or otherwise damage the good name of other Users, third parties or THE GINZA (including its affiliated companies and employees of THE GINZA and its affiliated companies)
  3. Any act that infringes or may infringe upon the property rights or privacy of other Users, third parties or THE GINZA (including its affiliated companies and employees of THE GINZA and its affiliated companies)
  4. Any act that infringes or may infringe upon the intellectual property rights (including copyrights, design rights, patent rights, utility model rights and trademarks) or image/portrait rights of other Users, third parties or THE GINZA (including its affiliated companies and employees of THE GINZA and its affiliated companies)
  5. Any act of sending or writing harmful computer programs, etc.
  6. Any act that offends or may offend public order and moral standards of decency, or that constitutes or may constitute a criminal act
  7. Any act of using or preparing to use the Services for commercial purposes
  8. Any act that, at the time of conducting communications via other network services at home or abroad, violates the rules of such network services
  9. Any act that causes excessive load to the server of the Services or causes a hindrance to the network system of the Services
  10. Election campaign activities or any similar acts, or any other act that relates to politics and/or religion
  11. Any act that violates these Terms or hinders operation of the Services
  12. Any act that violates the laws of Japan or whatever country or region Users are in when using the Services
Article 7 (Responsibility regarding Use of Information provided on the Website)

THE GINZA makes no warranties as to the integrity or usefulness of the information that Users obtain through the Website, including information originating from other Users. All Users will make use of the Website on their own responsibility and judgment, and THE GINZA will not be held responsible for any result of using or relying on such information.

Article 8 (Copyrights and Other Intellectual Property Rights)
  1. All rights relating to all content displayed on the Website belong to THE GINZA or are used under license or other legitimate title by THE GINZA, and THE GINZA prohibits Users from using any and all content displayed on the Website for any purpose other than personal use, from redistributing said content to the public, and from using or reproducing said content without permission, either within or outside the network.
  2. All trademarks and service marks appearing on the Website belong to or are used under license or other legitimate title by THE GINZA or its affiliated companies, and THE GINZA prohibits Users from using any such trademarks and service marks without permission.
  3. Any copyrights (including rights provided for in Article 27 and Article 28 of the Copyright Act) or other intellectual property rights arising from or in connection with information provided by Users will be transferred from Users to THE GINZA free of charge, and Users shall not exercise author’s moral rights or any similar rights whatsoever.
Article 9 (Change, Addition and Termination of Services)
  1. In any of the following events, THE GINZA may terminate or temporarily suspend the provision of all or part of the Services without giving prior notice to Users:
    • (1)In the event of regular or urgent maintenance of the systems that provide the Services;
    • (2)In the event of a failure of the systems that provide the Services;
    • (3)In the event of a power outage, fire, earthquake or any other force majeure that makes provision of the Services difficult; or
    • (4)In the event that there are other reasonable grounds related to the operation or technology of the Services.
  2. THE GINZA may make a change or addition to or terminate all or part of the Services without prior notice to Users.
  3. THE GINZA will not be held liable for any detriment or damage to Users as a result of any of the preceding actions.
Article 10 (Websites of Third Parties)

Links to third-party websites from the Website are provided for the convenience of customers and the content of these websites is neither guaranteed nor approved by THE GINZA. THE GINZA accepts no liability whatsoever for damages arising in connection with the use of such websites managed and operated by third parties that are linked from the Website and will not be obliged to compensate any such damages. Users who access third-party websites through the links provided on the Website will be deemed to understand this. "Privacy Policy."

Article 11 (Handling of Personal Information)
  1. THE GINZA does not, as a general rule, require Users to provide any personal information such as addresses or names that could be used to identify Users in order to access and view the Website.
  2. THE GINZA will appropriately manage all personal information obtained from customers in accordance with its "Privacy Policy."
Article 12 (Indemnity and Compensation for Damages)
  1. THE GINZA may claim reasonable damages against any Users who cause damages to THE GINZA through violation of these Terms or misconduct. Any Users who cause damage to third parties through use of the Services will be responsible for resolving this situation.
  2. THE GINZA will have no liability whatsoever to Users or third parties for any failure or breakdown of the systems that provide the Services, any intrusion to the systems by third parties, any commercial disputes or other issues, unless caused by willful misconduct or gross negligence on the part of THE GINZA.
Article 13 (Website Security)

The Website makes use of the following highly secure technologies, and protects the personal information of customers by maintaining a high level of security:

  1. Prevention of unauthorized access with a firewall
  2. Prevention of unauthorized access through periodic analysis of access logs and an intrusion detection system
  3. Data encryption
Article 14 (Collection, Use and Provision of Personal Information)
  1. THE GINZA collects information related to personal information which contains attribute information (such as age, gender, and residential areas) that does not correspond to personal information on its own or information about Internet use (such as IP addresses, MAC addresses, SSID, terminal identifiers such as cookies and RDID, and web beacons), and uses this information for the same purposes as the purposes of use of personal information specified in Article 11, Paragraph 2 as well as for the following purposes. THE GINZA may also use the collected information related to personal information by linking it to other personal data that it holds.
    • (1)For the purpose of temporarily storing information necessary for Users to view the Website more conveniently in cases where the Website contains an application which extends across multiple pages;
    • (2)For the purpose of referring to the Users' stored registration information when the Users are logged into the authentication service, in order to be able to provide individual Users with customized services;
    • (3)For collecting statistics on Users' access to the Services for analysis by THE GINZA or by companies to which THE GINZA entrusts research and analysis;
    • (4)For the purpose of optimizing advertising based on Users' usage;
    • (5)For the purpose of prompting Users to re-enter (re-authenticate) their passwords after a certain period of time has elapsed since their last use, in order to maintain security, when Users use the authentication service.
    In addition, THE GINZA may allow contractor companies to which it entrusts advertising (ad placement) work to save and refer to the Website’s cookies via their websites.
  2. THE GINZA receives information related to personal information from its affiliated companies as well as DMP providers and other advertising companies, research and analysis companies, media providers, database management companies and other contractors and business partners and uses this information for the same purposes as the purposes of use of personal information specified in Article 11, Paragraph 2 as well as for the purposes specified in each of the items of the preceding paragraph. THE GINZA may also use the received information related to personal information by linking it to other personal data that it holds.
  3. THE GINZA provides information related to personal information of Users to its affiliated companies as well as to DMP providers and other advertising companies, research and analysis companies, media providers, database management companies and other contractors and business partners
Article 15 (Link to Website)
  1. Users may freely establish a link to the Website from their own websites, except for those which include:
    • (1)Any content that is offensive to public order or moral standards of decency;
    • (2)Any content that violates laws or ordinances;
    • (3)Any content that defames THE GINZA (including its affiliated companies) or parties related to THE GINZA; or
    • (4)Any other content that can be objectively considered detrimental to the corporate value of THE GINZA.
  2. When linking to the Website, Users are requested to link to the top page of the Website, in principle. Users should note that the linked page is subject to change or deletion without prior notice to Users.
  3. THE GINZA accepts no liability whatsoever for any detriment arising from or in connection with relocation or deletion of the page at THE GINZA’s own convenience
Article 16 (Governing Law and Jurisdiction)

The Website and these Terms shall be governed, construed and applied in accordance with the laws of Japan. Unless otherwise provided, any and all disputes arising from or in connection with the Website shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
